The ex-lawyer for the former president has stepped down as New Jersey's top federal prosecutor. This follows a court battle that invalidated her legal standing to hold the office.
Acceptance of Resignation
The nation's top law enforcement official, Pam Bondi, announced Habba's resignation on the start of the week. She commented that the appeals court finding made it "untenable" for Habba to effectively run her office.
"Let no one confuse following the order as giving up," Habba stated. "This battle will now stretch across the nation."
Judicial Challenge
The departure was triggered by a judicial panel determined that she had been unlawfully serving as US attorney. This ruling is likely to affect scores of prosecutions in the state.
The judicial panel ruled that a interim role that did not receive confirmation by the US Senate ran afoul of the statute on vacant positions.

It was also stated that the former prosecutor will stay on at the justice department as a high-level advisor. Habba plans to pursue additional appeals of the disqualification, with hopes of a reversal.
Writing online, she wrote that the judiciary "must not override the appointment of prosecutors entrusted with carrying out the primary duty of the administration of enforcing the law."

She praised her tenure and pointed out that during her run, the state capital of Newark saw a one-fifth decrease in offenses. Additionally that the city of Camden had its first summer in 50 years without a homicide.
Legal Career
The 41-year-old attorney, first joined the former president's legal defense in 2021. She later defended her client in his New York criminal case in the previous year, when he was conviction on multiple felony counts of financial record manipulation.
Earlier, assuming the role of US Attorney, Trump had stated he was naming her as his presidential counsellor if re-elected, describing her as deeply loyal and a dedicated fighter for justice.
