Federal Judge Orders Release of Kilmar Abrego Garcia from ICE Custody
A court has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement lacks legal authority.
"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her ruling.
The case stems from a mistaken removal to El Salvador earlier this year, which the government later admitted was an error. After his return to the United States to face human smuggling charges, he was detained in federal detention.
In her order, the judge pointed out that the authorities lacks a valid deportation order, which prevents them from removing Mr. Abrego Garcia "for now."

The court proceedings involve disputed assertions. Whereas the Trump administration contends that Abrego Garcia is a affiliate of the MS-13 gang, he vehemently disputes this allegation.
